Parental Relocation

Our Helpful Parental Relocation Services

Individuals may decide to move for a number of reasons, from a desire to start fresh to obtaining a new job. However, relocating becomes slightly more complicated in child custody cases. Parental relocation is, essentially, when a parent wishes to permanently move to a location at least 50 miles away. It is possible for both parents to come to an amicable agreement regarding child custody. In this case, they would both sign a form consenting to the move, which they would present to the court.

Oftentimes, however, relocation is a contested issue. If this is the case, the parent wishing to relocate would need to file a petition including several pieces of information. This includes:

  • The reasons they wish to move.
  • Where they're moving to and how to contact them.
  • The date when they wish to move.
  • A plan for a modified visitation schedule with information on how they'd transport the child to and from their location.

After this petition is filed, the other spouse has the chance to offer a response. Once the response is given, the court will decide whether or not the relocation request is granted. This is determined by a number of factors, including such things as the child's preference, how the move would affect the child's development, and what the child's current needs are.
