If your—or your former partner’s—life circumstances change, then you may wish to modify child custody or support. The two may be modified due to a number of differing reasons. Child support, for example, may require modification because of:
- An increase or decrease in income.
- An increase or decrease in expenses for the child.
- Changes to the amount of time the child spends with each parent.
In order to modify child support, you must file a Supplemental Petition to Modify Child Support, and then give it to the other partner. At this point, they have the opportunity to respond. How they respond determines whether the child support modification will go smoothly, or whether it will be taken to trial for the court to decide.
Changes to child custody similarly happen due to changing life circumstances. These changes must not have been known of or anticipated at the time the original child custody agreement was made. Additionally, they must be substantial enough to warrant a change on the child’s behalf. You must fill out several forms and serve them to the other partner in order for the change to take place.
